These Terms of Service ("Terms") govern your access to and use of nexteo.ai and app.nexteo.ai (the "Service"), operated by NextEO, part of MediaSavior L.L.C. ("NextEO," "we," "us," or "our"). By using the Service, you agree to these Terms.

Use of the Service

NextEO is an AI search visibility platform: it analyzes how AI assistants discover, trust, and recommend your brand, and helps you improve it. A free AI Visibility Checker is available without an account; the full platform requires a paid subscription. You may use the Service for lawful purposes only, and only to analyze and optimize websites you own or are authorized to manage. You agree not to:

Use the Service to access, analyze, optimize, or target systems you do not own or have permission to manage
Attempt to overload, disrupt, reverse engineer, or circumvent the infrastructure of the Service
Use automated tools or scripts to submit requests that degrade service quality for other users
Resell, sublicense, or expose the Service or its outputs except as expressly permitted by your plan
Violate any applicable law, regulation, or third-party AI provider terms

Subscriptions, Billing & Trials

Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor (Stripe). Plans renew automatically until cancelled. Where a free trial is offered, you must provide a valid payment method; unless you cancel before the trial ends, your plan begins and your payment method is charged automatically. Fees are non-refundable except where required by law. You authorize us to charge your payment method for all fees, applicable taxes, and any usage-based or per-website add-ons associated with your plan.

Usage Limits, Fair Use & Throttling

Each plan includes defined entitlements (for example, the number of websites, AI tests, integrations, and team members). We may meter, rate-limit, throttle, or temporarily suspend resource-intensive operations to protect the Service and other customers, and we may impose reasonable fair-use limits even on features described as "unlimited" to prevent abuse or runaway cost. We may change entitlements, limits, and the features included in each plan at any time; material changes affecting active subscriptions will be communicated where practicable.

Plan Changes, Pricing & Cancellation

We may modify pricing and plan features. For active subscriptions, price changes take effect at your next renewal. You may upgrade, downgrade, or cancel at any time from your billing settings; downgrades and cancellations take effect at the end of the current billing period, and you remain responsible for fees already incurred. Upgrades and certain plan changes may be prorated. Downgrading may reduce or remove access to features, websites, or data beyond your new plan's limits.

Suspension & Termination

We may suspend or terminate your access, with or without notice, for non-payment, violation of these Terms or the Acceptable Use Policy, suspected fraud or abuse, or to comply with law. We may also discontinue features or the Service. On termination, your right to use the Service ends; we may delete your data after a reasonable period.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranty of any kind. NextEO relies on third-party AI providers and public data sources whose outputs and availability we do not control; AI results, scores, and recommendations are estimates that may be inaccurate, incomplete, or change over time, and are not guarantees of any ranking, citation, traffic, or business outcome. You are responsible for reviewing changes before applying them to your site.

Limitation of Liability

To the fullest extent permitted by law, NextEO and MediaSavior L.L.C. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Intellectual Property

All content, branding, and code comprising the Service are the property of NextEO, part of MediaSavior L.L.C.. You may not reproduce or redistribute any part of the Service without prior written permission.

Changes to These Terms

We may modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.
